Reasons for Proposal

The current law prohibits displaying content in advertisements that: justifies criminal acts or expresses them cruelly; is likely to harm public morals due to obscene or decadent content; or is likely to infringe on human rights due to racist or sexist content.


However, recently, banners displaying false information or content that raises concerns about human rights infringement are being installed indiscriminately. Especially when a political party installs such advertisements, it is difficult to actively crack down due to concerns over infringing on the party's political activities.


Therefore, this proposal seeks to strengthen regulations by adding content that includes false facts to the list of prohibited advertising content, and by introducing penalties for cases where advertisements display false facts or content that raises concerns about human rights infringement (Draft Article 5, Paragraph 2, Subparagraph 5-2; Article 17-3; and Article 18, Paragraph 1, Subparagraph 3).
