Reasons for Proposal

The current Act stipulates that interested persons of specific fire-fighting objects shall, within 30 days after conducting an in-house inspection of fire-fighting systems or such, report the results of the inspection to the head of a fire defense headquarters or the head of a fire station.
However, critics point out that the safety control of fire-fighting objects is limited since it takes at least 2 to 3 months to report in-house inspection results and make improvements to fire-fighting systems and such in accordance with orders to take measures issued by the head of a fire defense headquarters, etc.
Accordingly, the Amendment prescribes that where an interested person, etc., of a specific fire-fighting object has conducted an inspection of fire-fighting systems or such and has found any significant risk factor, he or she shall immediately report the fact thereof to the head of a fire defense headquarters or the head of a fire station, thereby aiming to promote the prompt improvement of fire-fighting systems or such and thoroughly ensure fire prevention and safety control.

Details

A. Require any interested person, etc., of a specific fire-fighting object who has found a significant risk factor in an inspection of fire-fighting systems or such to immediately report the fact thereof to the head of a fire defense headquarters or the head of a fire station (Article 25, paragraph 2).
B. Prescribe that where the head of a fire defense headquarters or the head of a fire station has received a report on an in-house inspection from an interested person and finds that there is any significant risk factor, he or she shall issue an order to the interested person to take the necessary measures (Article 25, paragraph 3).
C. Prescribe that where the head of a fire defense headquarters or the head of a fire station has issued an order to an interested person to take the necessary measures, he or she shall publicly announce the details of the order to take measures and the results of the execution thereof within a certain period (Article 25, paragraph 4).
D. Prescribe a fine of up to 5 million won for any interested person who has found a significant risk factor in an inspection of fire-fighting systems or such but fails to report or falsely reports the results of the inspection (Article 50, subparagraph 7-2).



 

Major Provisions

Require any interested person, etc., who has found any of the following significant risk factors in an inspection to immediately report the fact thereof to the head of a fire defense headquarters or the head of a fire station (Article 25, paragraph 2).
