Reasons for Proposal
Under the current Act, the sale of high-caffeine foods to children may be prohibited or restricted only at schools or exemplary business establishments that sell children's favorite foods.
However, high-caffeine foods may adversely affect the healthy growth of body and mind, by causing insomnia, behavioral anxiety, and growth inhibition, etc., if children continue to consume the foods. Accordingly, this amendment aims to totally prohibit the sale of high-caffeine foods to children.
Major Provisions
No one shall sell (including sales through an automatic machine, unmanned vending machine, or telecommunications system) high-caffeine foods to children or provide such high-caffeine foods to children free of charge. In this case, the Minister of Food and Drug Safety shall define and notify the high-caffeine foods prohibited to be sold (Article 8 (3)).
