Reasons for Proposal
The current Act prescribes that driving any motor vehicle used for transport business or a truck, etc., not equipped with a tachograph shall be prohibited on road.
However, the Act does not restrict the driving of a motor vehicle not equipped with a speed-limiting device.
Speeding of trucks, etc., however, is highly likely to cause major traffic accidents, and therefore, critics say that there is a need to punish a person who drives a truck, etc., for i) not equipping his/her vehicle with a speed limiting device, which is the bare minimum of safety device, or ii) equipping his/her vehicle with speed limiting devices unusable due to any malfunction, etc.
In response, this Act aims to prohibit the on-road driving of a truck, etc., not equipped with a speed limiting device, and to establish relevant penal provisions thereof (Article 50 (5) 3 newly inserted).
