Reasons for Proposal
Under the current Act, the term "social welfare facility" means any facility established to implement social welfare programs and to provide users with various social welfare services by employing social workers and other employees.
However, there have been cases where social welfare facilities established and operated by certain religious corporations violate the freedom of religion of its workers by forcing them to participate in religious ceremonies or events and suspending, dismissing, or recommending the resignation of those who have refused, requiring measures to address the issue.
Accordingly, the Amendment stipulates that persons who establish and operate a social welfare facility and heads of social welfare facilities shall not force any worker, occupant, or user of a facility to engage in religious acts, and imposes a fine of up to 3 million won for non-compliance, thereby guaranteeing the freedom of religion of the workers, etc., of social welfare facilities (Article 35-3 newly inserted and Article 55 amended).
Major Provisions
