Reasons for Proposal

There are increasing numbers of cases of physical and psychological damage inflicted by verbal abuse, physical abuse, ostracism, and other forms of workplace bullying, and even some victims died from such cases. However, there are no legal grounds on which to prohibit workplace bullying, making it difficult to protect the victims.

Accordingly, the Amendment prohibits workplace bullying, where an employer or worker uses his or her superior position or relationship to inflict physical or psychological pain on another worker or undermine the work environment; obligates employers to take action in the event of workplace bullying, such as by changing the place of work or issuing an order for paid leave; prescribes disciplinary action against perpetrators; includes in the rules of employment matters concerning measures to prevent and address workplace bullying to be included in the rules of employment; and prescribes provisions on the division of the burden of proof, thereby aiming to provide greater protection for workers who have been victimized by workplace bullying (Article 76-2 through Article 76-5 newly inserted; Article 93, subparagraph 12 newly inserted, etc.).
