Reasons for Proposal
The current Act prohibits the use of cell phones and the operation of video display terminals while driving, but does not prohibit smoking while driving.
However, the acts of looking for or lighting a cigarette can distract a driver from keeping eyes forward in the same manner as the use of cell phones and the operation of video display terminals. Thus, critics suggest that a provision that prohibits smoking while driving is needed.
Accordingly, the Amendment newly inserts provisions to prohibit drivers from smoking while driving and prescribes a fine of up to 200,000 won, penal detention, or fine for negligence for non-compliance, thereby aiming to strengthen the obligation to maintain a forward gaze while driving (Article 49, paragraph 1, subparagraph 11-3 newly inserted).
