Reasons for Proposal
The current Act requires persons who have installed waterside excursion type amusement facilities or amusement equipment to observe the safety and sanitation standards prescribed by Ordinance of the Ministry of Culture, Sports and Tourism, and imposes administrative dispositions, such as revocation of registration, against a person who fails to comply.
However, a recent water quality survey conducted by Korea Consumer Agency at four major water parks in Korea showed that all four locations have failed to meet international standards, and the level of water contamination at one of the locations was three times higher than the limit. These findings have sparked public concern and accordingly, critics point out that the safety and sanitation standards must be raised to the level of international standards to make sure that persons who have installed waterside excursion type amusement facilites or amusement equipement strictly manage and observe such standards. Plus, the relevant measures must be put in place to encourage the persons concerned to voluntarily abide by the standards on a regular basis.
Accordingly, the Amendment requires the Minister of Culture, Sports and Tourism to prescribe the safety and sanitation standards that meet international standards. It requires persons who have installed waterside excursion type amusement facilities or amusement equipment to conduct self-inspection for compliance with such standards and obligates them to display the results in an area that is clearly visible to ordinary visitors, thereby aiming to establish a permanent safety and sanitation system for waterside excursion type amusement facilities and amusement equipment (Article 32, paragraphs 2 through 5 newly inserted, etc.).
