Reasons for Proposal

The current Act prescribes that where a business operator manufactured, imported, sold or distributed everyday chemical products or biocides that are prohibited from manufacture or import or are unreported, the Minister of Environemnt may issue an order of recall, disposal, etc., of such products or biocides against the operator concerned and the person subject to such order shall take the required measures and report the results thereof to the Minister of Environment.

Although a business operator who fails to take the required measures shall be subject to imprisonment for up to seven years or a fine of up to seventy million won, there is no ground on which to impose sanctions on a business operator who fails to report the results of the required measures in violation of the law, such that it is impossible to punish such business operator even if he/she carries out inappropriate measures and makes a false report.

Therefore, this Amendment imposes an administrative fine of up to thirty million won on a business operator who fails to make a report after carrying out a recall order or who makes a false report about the results thereof, thereby effectively managing the recall order system (Article 60 (1)).

Major Provisions

Prescribe that a person who fails to make a report after taking measures according to a recall order or who makes a false report about the results of such measures shall be subject to an administrative fine of up to thirty million won (Article 60 (1))
