Reasons for Proposal
The current Act punishes persons who provide entertainment services or request other persons to provide such services at a karaoke bar. However, it does not prescribe punishments for persons who demand or are provided with such services and as a result, criminal acts continue to occur. The sector concerned is a criminal blind spot as indicated by the fact that 1,300 people were arrested for the last five years for non-compliance with youth employment laws at karaoke bars, etc.
There is also a need to address the growing number of cases where people take advantage of the situation by demanding illegal entertainment workers and then threatening or blackmailing food service business operators to obtain unjust enrichment.
Accordingly, the Amendment punishes persons who provide or request other persons to provide entertainment services at a karaoke bar as well as persons who demand such services, thereby aiming to prevent unjust enrichment of users taking advantage of loopholes in the law (Article 44, paragraph 3 and Article 98, Article 98-2).
