Reasons for Proposal

Under the current Act, food service business operators are prohibited from a) having juveniles provide entertainment services by employing them as entertainment workers; b) employing juveniles in or giving them access to business establishments banned from employing juveniles or giving them access; c) providing alcoholic beverages to juveniles, and if they violate the Act, their business shall be suspended or their business licenses be revoked.

Recently, however, juveniles are giving cause for concern in such a way that they are gaining access to business establishments banned from allowing their access and employing them by deceiving food service business operators into failing to recognize their identities through forgery, falsification of their ID cards, and identity theft.

Accordingly, the Amendment aims to reduce or exempt administrative disposition on the food service business operator in question, where juveniles deceived food service business operators into allowing their access to and employing them in their business establishments through forgery, falsification of their ID cards, and identity theft while notifying the persons with parental authority and the head of the school of such fact to ensure that guidance and protection for them are implemented (Article 75-1, proviso to subparagraph 13 and Article 92, subparagraph 2 newly inserted).

Major Provisions

Where juveniles deceived food service business operators into committing violations of Article 44-2 through forgery of their ID cards, the persons with parental authority and the head of the school who were notified of such fact shall implement guidance and protection measures for the juveniles in question such as professional counseling and volunteer work (Article 92-2, paragraph 1)
