Reasons for Proposal

The current Act requires owners and managers of terrorist target facilities and means of terrorism to strive to eliminate factors vulnerable to terrorism, such as by installing security equipment. At the working level, all passengers and baggage using aviation services, ports, etc., are subject to security screening and thus, the corresponding security screening equipment has been obtained and operated.

The Aviation Security Act to be enforced in October 2018 ensures efficient management of the use of aviation security equipment by airport operators and air transportation business entities, etc., by newly inserting provisions concerning the performance of aviation security equipment; standards, methods, and procedures for certification; performance testing of security equipment; and other matters necessary for operation. However, the current Act does not contain provisions concerning the standards, methods, and procedures for domestic certification of security equipment; performance testing of security equipment; or other matters necessary for operation with respect to the installation of security equipment by the owners and managers of terrorist target facilities and the means of terrorism.

Terrorist target facilities and the means of terrorism are important in terms of public safety and national security. Thus, it is necessary to ensure security equipment demonstrate a sufficient level of anti-terrorism screening ability, etc., by prescribing that only equipment that has been certified by a professional institution shall be used.

Accordingly, this Amendment prescribes provisions concerning the performance of terrorism-related security equipment; standards, methods, and procedures for certification; performance testing of security equipment; and other matters necessary for operation, thereby aiming to ensure the efficient and appropriate management of security equipment (Articles 11-2 through 11-7 and Articles 20 through 22 newly inserted).

Major Provisions

Require any manager, etc., who installs security equipment pursuant to this Act to use security equipment with a State-issued performance certification (Article 11-2)
