Reasons for Proposal
The current Act stipulates that the editors of newspapers and online newspapers, and the news article layout managers of online news services shall edit news articles by clearly distinguishing news articles from advertisements so that readers do not confuse news articles with advertisements. However, critics point out that it is difficult to ensure the effectiveness of this provision since the Act does not contain penal provisions applicable to the matter.
Accordingly, the Amendment imposes an administrative fine of up to 20 million won on any person who fails to edit news articles and advertisements such that they are clearly distinguished from each other, thereby aiming to ensure the effectiveness of penal provisions (Article 39, paragraph 1, subparagraph 1 newly inserted).
