Reasons for Proposal

The Current Act imposes a charge for an additional amount of up to five times the full amount subject to return, in addition to restricting further assistance within one year and ordering to return the subsidies already provided by fraud or other improper means, as disadvantageous measures against a person who has obtained the subsidies provided in relation to any program for employment security and vocational skills development by fraud or other improper means.

It was recently found that some business owners have obtained assistance provided in relation to the program for employment security of more than 100 million won by improper means, so there is a growing demand that in a case where a business owner obtains a large amount of assistance by improper means, the upper limit of the support restriction period should be raised.

Accordingly, the amendment aims to prevent improper receipt of subsidies in a deliberate and organized manner, by extending the assistance restriction period up to three years for those who obtain subsidies by fraud or any other improper means (Article 35 (1)).

Major Provisions

A person who attempts to obtain, or has already obtained assistance provided in relation to any program for employment security and vocational skills development prescribed in this Chapter by fraud or other improper means, shall not receive the subsidies sought nor the remainder of subsidies yet to be offered.

The restriction period for assistance shall be extended, as prescribed by Presidential Decree, to three years (Article 35).
