Reasons for Proposal

In 2017, the National Assembly Audit of the Ministry of Culture, Sports and Tourism revealed that officers at the Korea Anti-Doping Agency (hereafter “Anti-Doping Agency”) had inappropriately received several million won as work allowance while supervising the doping check tasks over organization committees of seven international games including the 2014 Incheon Asian Games, and had also hired employees in inappropriate manners, shocking the public to a great extent.

The main business carried out by the Anti-Doping Agency especially requires fairness since it involves managing the result of doping checks and imposing sanctions according to such results. It is therefore necessary to establish appropriate measures to ensure the accountability of the officers at the Anti-Doping Agency, and to enhance the authority of an auditor who audits the Agency’s accounting and business status.

As such, this proposal seeks to raise the level of the Minister of Culture, Sports and Tourism’s officer approval provisions as prescribed under the Agency’s articles of association into law, and to allow the auditor to report to the Agency and request an audit to the Board of Audit and Inspection if the auditor discovers inappropriate conduct in regard to the Agency’s asset status or work execution. The proposal also deems the officers of the Anti-Doping Agency to be public officials when applying the provisions under Criminal Act Articles 129 to 132, seeking to secure fairness and accountability in the operation of such officers (Newly insert Articles 35-2, 35-3 and 35-4, etc.).

Major Provisions

Article 46-3 (Deeming of Anti-Doping Agency Officers as Public Officials) Officers of Anti-Doping Agency shall be deemed as public officials when applying the Criminal Act Articles 129 ~ 132.
