Reasons for Proposal
Recently, the whole country was shocked by a series of surrogate surgery by medical equipment company staff and assistant nurses. The testimonies of medical workers confirm that the practice of secret illegal behaviors in the operating rooms of hospitals has been carried out for many years. Particularly, in the case of the orthopedic clinic in Yeongdo-gu, Busan, the director had a medical device salesperson perform an operation, which caused the patient to become brain dead.
However, the current Act only stipulates a case where medical personnel has any person other than medical personnel provide medical services for reasons of suspending medical personnel’s licenses, and thus medical personnel who have committed unethical behavior are able to return to the medical field after the suspension period.
Accordingly, this amendment aims to stipulate that the Minister of Health and Welfare shall cancel the medical personnel’s license when he/she has any person other than medical personnel provide medical services (Article 65-2 newly inserted).
