Reasons for Proposal

The current Act provides that the standards for granting permission for a tramway business require that the business conform to the construction and equipment standards of tramway facilities, and obtain permission or approval from the heads of the competent administrative agencies or managers when a tramway occupies forests, parks, etc.

However, there is no provision concerning the term of validity of such permission. This raises continuous concerns regarding the limited business participation opportunities as well as the safety of tramway operations, since there are cases where tramway services are being provided for decades without a change in the provider, in forests and parks, etc., which have strong characteristics of public goods.

Therefore, this proposal seeks to expand the opportunities for participating in tramway business as well as to contribute to improved safety of tramway operations through requiring the term of validity of a tramway business permission to be determined within a limit of 30 years under standards specified by Presidential Decree, and allowing re-approval of such permission when that term of validity expires (Newly insert Article 4, paragraph 7 and 8).

Major Provisions

The term of validity for tramway business permission in accordance with paragraphs 1 and 2 shall be determined within a limit of 30 years under standards specified by Presidential Decree, and may be re-approved upon expiration of such term (Article 4, paragraph 8).
