Reasons for Proposal

The current Act provides that an order to temporarily suspend movement of livestock, etc., can be issued if it is deemed that the national economy will be seriously damaged due to the outbreak or nationwide spread of a contagious animal disease.

However, compared to cows or pigs, fowl livestock such as chickens, ducks, etc., which have shorter breeding times, are more difficult to track, and there are arguments for the necessity of a pre-reporting system for bird farms to inspect their compliance with disease control and standards. Additionally, there are criticisms for the fact that the temporary suspension of movement is only issued after a disease has been confirmed, which puts limitations on initial disease control.

Therefore, this proposal seeks to enhance the disease control system by allowing heads of Si/Do as well as the Minister of Agriculture, Food and Rural Affairs to issue an order restricting the rearing of livestock in Districts Subject to Intensive Disease Control; implementing a pre-reporting system for new breeding fowls for bird farms; and allowing temporary suspensions of movement orders to be issued even when there is only the suspicion of such animal disease. Major Provisions

Article 15-2 (Pre-reporting of new-breeding livestock) 1) Livestock prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs such as chickens, ducks, etc., shall be reported to the head of si/gun/gu prior to new breeding on the farm. The report shall include items prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs such the kind, number, etc. of livestock. In such cases, the owners, etc., of the livestock shall comply with the standards for disease control pursuant to Article 17-6.

Article 19-2 (Order to Temporarily Suspend Movement of Livestock, etc.) 1) Where the Minister of Agriculture, Food and Rural Affairs, or the head of si/gun/gu, or the head of Special Metropolitan City decides that the national economy will be seriously damaged due to the suspicion or outbreak, or nationwide spread of a contagious animal disease prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs, such as foot-and-mouth disease, he/she may order the temporary suspension of the movement of livestock, vehicles having access to facilities or persons engaged in livestock-related work, such as veterinarians, veterinary assistants or animal inseminators (hereinafter referred to as "persons engaged in livestock-related work") that may transmit the relevant contagious animal disease to prevent the nationwide spread of the relevant contagious animal disease.
