Reasons for Proposal

The current Act provides that individuals other than the State, a local government, or a school juristic person may establish and operate a kindergarten. However, some kindergartens operated by individuals are raising public criticism due to corruption and inappropriate conduct, etc.

Additionally, individuals are allowed to establish and operate private kindergartens whereas in cases of other school levels including elementary, middle, high school and university/special school, etc., only school juristic persons can establish/operate private schools in principle. This calls for a systematic improvement.

This proposal therefore seeks to secure publicness, transparency and healthiness of kindergartens, to enhance parental trust of the institution, and to protect the educational rights of the kindergartener through provisions not allowing the establishment and operation of a private kindergarten unless established/operated by a school juristic person (Article 3, paragraph 1, subparagraph 1).

Note
This proposal presumes the passage of Partial Amendment of Child Education Act (Proposal No. 16476) as introduced by National Assembly Member Yoon, So-ha. Therefore, if the said Amendment proposal does not pass or passes in an amended form, adjustments need to be made accordingly.
