Reasons for Proposal
There have been recent cases where the original form of buried cultural heritage was damaged due to the burying of construction waste in certain heritage sites. However, current law lacks specific provisions regulating such matters, which is raising concerns about the difficulties in protecting the original form of buried cultural heritage.
Therefore, this proposal seeks to effectively preserve buried cultural heritage sites by requiring any implementer of construction works not to harm the original form of an area of buried cultural heritage through burying or placing of waste created by construction works. Violation of such requirement will result in five years in prison or a statutory fine of up to fifty million won (Newly insert Article 10, paragraph 3; Newly insert Article 35-2)
Major Provisions
Article 10 (Obligation, etc., of Implementers of Construction Works following Preservation Measures)
(3) Implementer of construction works shall not damage the original form of an area of buried cultural heritage through burying or placing of waste created by construction works.
Article 35-2 (Crime of damaging Area of Buried Cultural Heritage)
Any person in violation of Article 10, paragraph 3 will be subject to five years in prison or up to fifty million won in statutory fines.
