Reasons for Proposal

According to the current Act, a person who intends to load, transport, or store dangerous goods by or on a ship may have a specialized agency perform affairs concerning a survey and approval on the suitability of the method, on his/her behalf. However, the Act has no stipulation on the eligibility, job responsibilities and dismissal, etc., of a dangerous goods surveyor who conducts the relevant survey directly at the specialized agency.

Therefore, the Amendment aims to prescribe the details of the eligibility, job responsibilities and dismissal, etc., of the dangerous goods surveyor (Article 77-2 and Article 78).

Article 77-2 (Dangerous Goods Surveyor)
③ When a dangerous goods surveyor violates this Act or any order issued under this Act in performing any of his/her duties, the Minister of Oceans and Fisheries may request an agency for examination, etc., of dangerous goods to dismiss him/her or to suspend his/her duties for a fixed period of up to one year.
④ An agency for examination, etc., of dangerous goods is requested to dismiss a dangerous goods surveyor or suspend his/her duties under paragraph (3), it shall take the measures for the relevant dangerous goods surveyor without delay and inform the Minister of Oceans and Fisheries of the results thereof.
