Reasons for Proposal

Current law specifies Prohibited Acts/Facilities, etc., in Educational Environment Protection zones to protect the health and sanitation, safety, learning, and educational environment of students. Types of such facilities are the crematoria facilities under subparagraph 8 of Article 2 of the Act on Funeral Services, etc., and charnel facilities under subparagraph 9 of the same Article;
However, there are recent disputes between local governments and businesses regarding the installation of animal crematoriums, and it’s been pointed out that while the current Educational Environment Protection Act includes human crematoriums as referred to in the Act on Funeral Services, it does not encompass the animal crematoriums as referred to in the Animal Protection Act.
Therefore, this proposal seeks to prevent disputes between local governments and business and to ensure the protection of educational environments for the students by adding animal crematoriums as referred to in the Animal Protection Act as a prohibited facility under the Act (newly insert Article 9, paragraph 9-2).

Major Provisions

Prohibit the installation of Funeral services for animals as referred to in Article 32, paragraph 1, subparagraph 1 of the Animal Protection Act in Educational Environment Protection zones (Article 9)
