Reasons for Proposal
The current Act prescribees that a shipowner shall maintain the state of the hull, engine, facilities, etc., of the relevant ship for normal working and operation after the ship survey, etc. However, the scope of maintenance duty on the state of the ship is unclear, and a punishment clause for violation of this duty is not specified.
Therefore, the Amendment aims to explicitly prescribe the related provisions and strengthen the responsibility of a shipowner with respect to the maintenance and management of his/her ship (Article 15 and Article 83).
