Reasons for Proposal

Recently, problems with the radiation safety control system for household products have been discovered such that products not in conformity with safety standards with their exposure dose discharged from processed products exceeding 1 millisievert (mSv) a year are found on many occasions in various products such as beds, latex, pillows, etc.

Under the current law, there are no specific standards for disposal of such nonconforming-processed products, and there are no regulations on the collection/disposal of nonconforming processed products directly purchased by consumers from abroad.

Accordingly, the ACT aims to improve the safety control system for radiation in the natural environment by putting standards and procedures in place for disposal of nonconforming-processed products, and to prepare the procedures for collection/disposal of nonconforming-processed products directly purchased from abroad.

Details

A. Prescribe that plans for disposal of nonconforming processed products must be established to meet the standards for radiation effects, classification of products subject to disposal, etc. (Article 16, paragraph 2 newly inserted)

B. If measures for the smooth collection of nonconforming-processed goods are difficult to be taken with the manufacturer’s fulfillment effort only, prescribe the obligations of the related institutions to cooperate and support upon request of the Nuclear Safety and Security Commission (Article 16, paragraph 4 newly inserted)

C. Arrange that the Nuclear Safety and Security Commission may implement the collection/disposal of them with the local government if the products, etc., directly purchased by consumers from abroad are found to be nonconforming (Article 17-2 newly inserted)

Major Provisions

Require a manufacturer who has taken measures according to paragraph 1 to report the result of the relevant action to the Nuclear Safety and Security Commission as prescribed by Ordinance of the Prime Minister; and in such cases, allow the Nuclear Safety and Security Commission, if it deems the result of the relevant action insufficient, to order the manufacturer’s rectification and improvement (Article 16, paragraph 3)
