Reasons for Proposal
Thanks to continuous efforts to strengthen railroad safety, railroad accidents and operational failures in Korea have been reduced to exemplary levels. However, this is not enough to meet public expectations as fatalities, failures, and other key indicators are decreasing at a slowing rate and unexpected accidents are continuing to occur. A new approach is necessary to achieve higher levels of railroad safety.
Thus, there is a need to shift the focus of railroad safety control from the current emphasis on measures to prevent the recurrence of railroad accidents and operational failures to proactive management of risk factors and other preventive and preemptive measures.
Accordingly, the Amendment newly inserts quasi-railroad accidents and a voluntary reporting system, increases the scope of persons with reporting obligations, and otherwise reforms the railroad accident reporting system, thereby aiming to contribute to the advancement of railroad safety (Article 2, Article 61, Article 61-2, Article 61-3, and Article 81).
Major Provisions
Require any railroad worker who is engaged in the driving of rolling stock, traffic control, or other affairs specified by the Ordinance of the Ministry of Land, Infrastructure and Transport, and who has caused or become aware of a railroad accident, etc., to report the fact thereof to the Minister of Land, Infrastructure and Transport as prescribed by the Ordinance of the Ministry of Land, Infrastructure and Transport; provided that this shall not apply to cases where the railroad operator, etc., has reported the railroad accident, etc., in accordance with paragraph 1 or 2 (Article 61, paragraph 3 newly inserted)
Prescribe that where a person has obtained a formal approval or approval for a manufacturer for rolling stock or railroad supplies in accordance with Article 26 or Article 27, and he or she has become aware of any fault, defect, or malfunction specified by the Ordinance of the Ministry of Land, Infrastructure and Transport in the approved rolling stock or railroad supplies caused by design or manufacturing defects, he or she shall report the fact thereof to the Minister of Land, Infrastructure and Transport as prescribed by the Ordinance of the Ministry of Land, Infrastructure and transport (Article 61-2, paragraph 1)
Prescribe that where a person has obtained an approval for a rolling stock maintenance organization in accordance with Article 38-7, and he or she has become aware of a fault, defect, or malfunction specified by the Ordinance of the Ministry of Land, Infrastructure and Transport in the course of operating or performing maintenance on rolling stock, he or she shall report the fact thereof to the Minister of Land, Infrastructure and Transport as prescribed by the Ordinance of the Ministry of Land, Infrastructure and transport (Article 61-2, paragraph 2)
