The current Act requires any person who intends to engage in construction business for the development and utilization of groundwater, conduct a groundwater impact investigation, or engage in groundwater purification business to file a registration with the head of the Si/Gun/Gu having jurisdiction over the location of his or her main office. However, it does not prescribe control procedures applicable after the registration.

It also requires workers and engineers in the business related to the development and utilization of groundwater to receive education and training conducted by the Ministry of Environment, but it only prescribes one training session within one year of registration and critics point out a need to improve the effectiveness of education and training.

Accordingly, the Amendment requires any person who intends to engage in construction business for the development and utilization of groundwater, conduct a groundwater impact investigation, or engage in groundwater purification business to submit to the head of the Si/Gun/Gu information concerning compliance with the criteria for registration every 3 years after registration, and prescribes that failure to submit or falsification of a submission of such information shall be punishable by an administrative fine of 3 million won. It also requires workers and engineers in the business related to the development and utilization of groundwater to be educated every 3 years, and otherwise modifies systems concerning groundwater management (Article 22, Article 27, and Article 29-2, etc.).

④ Any person who has filed a registration in accordance with paragraph 1 shall submit information on compliance with the criteria for registration to the head of the Si/Gun/Gu having jurisdiction over the location of his or her main office every 3 years as prescribed by Presidential Decree.

② Workers and engineers in the business related to the development and utilization of groundwater shall receive education and training conducted by the Minister of Land, Infrastructure and Transport every 3 years, and matters necessary for those subject to education, the content of education, educational institutions, etc., shall be prescribed by Presidential Decree.
