Reasons for Proposal

The current Act does not stipulate an obligation to mark allergenic food materials but instead the provisions regarding the persons responsible for labeling, etc. are prescribed by Ordinance of the Prime Minister, as “Matters to be Observed for Consumer Safety” under Food and Other Labels Standards.
Improper labeling of allergenic food materials may threaten the lives of consumers and an Amendment defining the basis for labeling and persons responsible for labeling, including providers directly selling food to consumers, is necessary.
The Amendment provides a basis for the labeling of allergenic food materials and defines the persons responsible for labeling as those who manufacture, process, subdivide, import, cook and distribute food and other consumables, while stating the administrative disposition or punishment for those engaged in the manufacture, processing, subdivision, importation, cooking, packaging, storage, display, transportation and distribution of food and other consumables without proper label to secure the effectiveness of allergenic food materials labeling (Article 4-2; Article 28, paragraph 1-2 newly inserted).

Major Provisions

Article 4-2 (Labeling of allergenic food materials)
1. Wherein the food contains allergenic ingredients or raw materials, the distributor of the food (food, food additives and livestock products; hereinafter the same shall apply) as defined by Ordinance of the Prime Minister, who are engaged in the activity of manufacturing, processing, subdividing, importing, cooking and distributing food must label the raw materials of allergenic food materials.
3. Food missing the label of allergenic food materials as stated in paragraph 1 or food violating the label standards and methods in paragraph 2 shall not to be used for sale and are not to be manufactured, processed, subdivided, imported, cooked, packaged, stored, displayed, transported, or distributed for the purpose of sale.
