Reasons for Proposal
The air transport service is a national basic industry, and the influence of an air transport service provider's behavior on the national image is significant; at the same time, the air transport service is responsible for the field directly related to users’ life and safety; thus, unlike other business fields, it requires a high level of expertise, management capability, and publicity.
However, in recent years, there have been cases in which the publicity that is especially required for air transport service providers has been degraded, some air transport service providers have used the air transport service licenses they have received from the government for the purpose of promoting the personal convenience of owners and related persons; and as a result, there has been a problem of not only losing confidence in the air transport service that is responsible for users’ life and safety but also causing adverse effects on the national image and credibility. Therefore, it is necessary to reaffirm the publicity of the air transport service and air transport service provider and prepare a plan to strengthen the publicity so that the same case is not repeated.
This amendment aims to improve the overall publicity of the air transport service and restore the national image and credibility by strengthening the publicity of the air transport service management, such as restricting any person who commits a crime that reduces the credibility of the air transport service from serving as an officer; and by strengthening the fairness of the allocation and operation of traffic rights, such as restricting for a certain period the allocation of a new traffic right to any air transport service provider who caused social trouble; and by improving the effectiveness of the administration of air transport service licenses, such as diversifying and strengthening the sanctions for illegal activities committed by air transport service providers and their officers.
Details
A. Restrict any person who commits a crime that reduces the credibility of the air transport service from serving as an officer, and restrict the concurrent service of officers between affiliated airlines (Article 9 and Article 9-2)
B. Restrict for a certain period the allocation of a new traffic right to any air transport service provider who caused a serious accident or social trouble (Article 16)
C. Set an expiration date of the right of traffic for an exclusive route and evaluate the freight charges and service of the route. Make an order to improve the service if necessary and establish grounds to withdraw the right of traffic when failing to comply with the order (Article 16)
D. Diversify administrative sanctions against illegal behavior committed by air transport service providers and their officers and strengthen the effectiveness of sanctions (Article 28 and Article 29)
