Reasons for Proposal

To prevent harm to public health caused by misuse or abuse of drugs, the current Act, except as otherwise provided for in this Act, allows only pharmacy founders to sell drugs at pharmacies, and prohibits the sale of drugs through information and communication networks.
However, since in reality there are many cases of illegal use of information networks to sell drugs, the amendment aims to eradicate the illegal distribution of drugs that threaten the public health, allowing the Minister of Food and Drug Safety to investigate, in cooperation with relevant administrative agencies, the status of illegal sales of drugs using information networks, publish the results, and accuse law violators (Article 50 (5) to (9) newly inserted).

Major Provisions

Article 50 (Distribution of Drugs) (6) If necessary for the investigation of the status, the Minister of Food and Drug Safety may request the cooperation of the heads of the administrative agencies concerned, providers of information and communication services under Article 2 (1) 3 of the “Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc.,” and mail order brokerage business operators under Article 20 of the “Act on the Consumer Protection in Electronic Commerce Transactions, Etc.,” such as the submission of relevant data. In this case, the person who is requested to cooperate shall comply with the request unless there is a justifiable reason to refuse.
