Reasons for Proposal

The current Act requires a manufacturer or importer, an automotive dismantler, an automotive scrap recycler, an automotive shredder residue recycler, or a waste gas treatment business operator to each observe the recycling rate prescribed by Presidential Decree when recycling vehicles, but due to the diffusion of responsibility as a result of a market structure of stage-by-stage connectivity, in reality, there is no principal entity responsible for recycling, and even when the target recycling rate is not met, it is difficult to impose corresponding sanctions.

Therefore, this proposal aims to introduce an Extended Producer Responsibility (EPR) system for vehicles in the same manner as for electrical and electronic equipment by designating a manufacturer or importer of a vehicle as the principal entity responsible for the recycling of end-of-life vehicles, and clearly prescribing the recycling system for end-of-life vehicles of a business operator recycling end-of-life vehicles, etc., thereby treating end-of-life vehicles in an environmentally friendly manner and improving the recycling rate of vehicles.

 

Details

A. Introduce an Extended Producer Responsibility (EPR) system for vehicles in the same manner as for other equipment, thereby clearly prescribing that the duty to achieve the recycling rate for an end-of-life vehicle is with the manufacturer or importer of a vehicle, while enabling a vehicle producer subject to mandatory recycling to fulfill its recycling duty by entrusting such duty to a business operator recycling end-of-life vehicles (including an agency composed of such business operators) or by establishing a mutual aid association to jointly fulfill its recycling duty (Article 25)

B. Prescribe the handover duty and recycling method to be applied when an automotive dismantler, an automotive scrap recycler, an automotive shredder residue recycler, or a waste gas treatment business operator recycles an end-of-life vehicle (Article 26)

C. Prescribe that a manufacturer or importer of a vehicle shall submit a plan of mandatory recycling to the Minister of Environment for his/her approval to fulfill its recycling duty, and that it shall submit a report on the results of mandatory recycling after fulfilling its duty (Article 28-2)

D. Enable the Minister of Environment to impose and collect charges for recycling vehicles when a vehicle producer subject to mandatory recycling fails to perform its recycling duty or a mutual aid association fails to perform its recycling duty on behalf of its member (Article 28-2)

E. Enable a vehicle producer subject to mandatory recycling to establish a mutual aid association for recycling vehicles when it aims to jointly fulfill its recycling duty, and enable the Minister of Environment to issue corrective orders, demand disciplinary action from or dismiss an executive officer or employee, or revoke authorization, when a mutual aid association for recycling vehicles violates the Act or its articles of association, etc. (Article 29, 30, and 30-2 through 30-4)


Major Provisions

- Prescribe recycling duty of a vehicle producer subject to mandatory recycling (Article 25)

- Prescribe handover duty and recycling method for an automotive dismantler, etc., to be applied when recycling an end-of-life vehicle (Article 26)

- Prescribe that a manufacturer or importer of a vehicle shall submit a plan of mandatory recycling to the Minister of Environment for his/her approval, and submit a report on the results of mandatory recycling after fulfilling its duty (Article 28-2)
