Reasons for Proposal

For apprentices engaged in apprenticeships to work in a safe and comfortable environment, it is important to prevent safety accidents.
The Occupational Safety and Health Act aims to maintain and promote the safety and health of employees by preventing industrial accidents and creating comfortable working environments, but it does not contain provisions to protect apprentices engaged in an apprenticeship relationship with an enterprise.
Accordingly, the Amendment aims to provide apprentices engaged in an apprenticeship relationship with an enterprise with the same level of protection as employees by making the safety and protection-related provisions of the Occupational Safety and Health Act applicable to apprentices.

Prescribe special provisions to protect apprentices by making provisions on health and safety measures to be taken by business owners, etc., provisions on health and safety education, provisions on management/supervision and penalties to ensure compliance, etc., under the Occupational Safety and Health Act applicable to apprentices, and thereby expand the application of measures to prevent and protect workers from safety accidents, etc., to apprentices (Article 166-2 newly inserted).

Major Provisions

Prescribe special provisions to protect apprentices by making provisions on health and safety measures to be taken by business owners, etc., provisions on health and safety education, provisions on management/supervision and penalties to ensure compliance, etc., under the Occupational Safety and Health Act applicable to apprentices, and thereby expand the application of measures to prevent and protect workers from safety accidents, etc., to apprentices (Article 166-2 newly inserted).
