Reasons for Proposal

The current Act stipulates that no foreigner shall be restricted from making any foreign investment except in circumstances where he/she threatens national security or the public order, violates any Act or statutes of the Republic of Korea, etc.

However, speculative foreign capital that has been introduced into the country is causing many issues such as slowing the growth potential of enterprises and undermining the management safety of enterprises through hostile mergers and acquisitions.
Accordingly, the Amendment aims to regulate speculative foreign capital to a reasonable extent that does not undermine the healthy inflow of foreign capital by adding cases that pose a very serious threat to the national economy as grounds to restrict foreign capital, prescribing that the Foreign Investment Committee shall deliberate on such cases, and allowing the investigation of matters concerning the impact of foreign investment on related industrial ecosystems and the national economy (Article 4, paragraph 2, subparagraph 4; Article 27, paragraph 1, subparagraph 6-2; and Article 28, paragraph 2, subparagraph 4 newly inserted).
