Reasons for Proposal

When aliens entering Korea for short-term stays, such as sightseeing, undergo an entry inspection by the immigration control officer, they should submit an entry report to the immigration officer according to the Enforcement Decree of the Immigration Control Act, but since there is no way to sanction an alien who filed the entry report with false information about the place of stay and contact information, it is difficult to guarantee the correctness of the entry report.

If an alien falsifies his/her place of stay in the entry report or changes his/her place of stay according to the domestic tourism schedule, etc., there are limits in efficiently managing foreigners staying in Korea, and thus, it is difficult to find the domestic location of infected foreign patients or criminals.

When an alien to stay in Korea for 91 or more days registers the alien registration, he/she should submit the proof of place of stay to the head of the local immigration and alien registration office, but there is no regulation for short-term staying aliens to submit the proof of place of stay, and thus this amendment aims to secure public safety by establishing a system that can adequately grasp information on staying in Korea for short-term staying aliens.

Accordingly, if an alien falsely submits the entry report, he/she shall be imposed an administrative fine by upgrading the entry report system under the Enforcement Decree of the Immigration Control Act to the Act, and when it is decided by Ordinance of the Ministry of Justice such as the issuance of emergency warnings under the Act on the Infectious Disease Control and Prevention Act or the issuance of terror alerts under the Act on Counter-Terrorism for the Protection of Citizens and Public Security, aliens who stay in Korea for a short period shall provide their personal information to accommodation providers, and the accommodation providers shall submit the information of the staying aliens to the Minister of Justice (Article 12 (1), Article 81-3, and Article 100 (1)).


Major Provisions

The amendment requires that aliens who stay in Korea for a short period shall provide their personal information to accommodation providers, and the accommodation providers shall submit the information of the staying aliens to the Minister of Justice, when it is decided by Ordinance of the Ministry of Justice such as the issuance of emergency warnings under the Act on the Infectious Disease Control and Prevention Act or the issuance of terror alerts under the Act on Counter-Terrorism for the Protection of Citizens and Public Security.
