Reasons for Proposal
Alcohol causes various diseases and alcoholism, and excessive drinking is a risk factor that contributes to mental disorders such as depression and suicide and social instability such as violence and driving under the influence. However, advertisement regulations on alcoholic beverages are not as strict as those on tobacco.
In this regard, this Act aims to tighten advertisement criteria defined in the Enforcement Decree, specify who has obligations to comply, and detail what advertisements are restricted in an effort to inform the public of the harms of drinking and promote people’s health.

A. Specify the alcoholic beverage advertiser as the alcoholic beverage manufacturer, importer, and seller and tighten advertisement criteria to strengthen restrictions for alcoholic beverage advertisement by making it mandatory to indicate warning phrases for excessive drinking not on beverage containers but directly in advertisements (Article 8-2 newly inserted).
B. Strengthen punishment for violations of alcoholic beverage advertisement regulations from up to 1 million won in fines to up to 1 year in prison or 10 million won in fines (Article 31-2, subparagraph 1-2 newly inserted).
