Reasons for Proposal
Due to recent drone attacks on oil facilities in a foreign country, terrorism based on drones is emerging as a new factor that threatens the defense of nationally important facilities and the safety of people.
However, the current Act does not allow a radio station to interfere with, impede, or obstruct the operation of other radio stations, and only allows it for industrial, scientific and medical equipment as an exception, which makes it impossible to hack drones using radio interference such as jamming of combat drones in a serious and urgent situation for people’s safety due to infiltration, provocation, or terrorism by an enemy.
To defend nationally important facilities and ensure people’s safety from the infiltration, provocation, or terrorism by an enemy, this Act aims to allow radio interference such as jamming of combat drones and allow approval as industrial, scientific and medical equipment if such equipment is developed (Articles 25, 29, and 58).
Major Provisions
Create Article 58 (1) 1-2 and a proviso clause in Article 58 (2), and change “Article 45” to “Articles 29 and 45” in Article 58 (3).
Article 58 (1) 1-2. Equipment designed to protect human life and property from the enemy’s infiltration, provocation, terrorism, or any response to such threats in a limited place by generating radio wave energy, or for other similar purposes, and applicable to criteria as prescribed by Presidential Decree.
However, Article 58 (1) 1-2 shall be authorized if technological levels under Article 45 are deemed acceptable.
