Reasons for Proposal
In a situation where, due to information and communications development, the majority of the public consume necessary information and news using the information and communications network, damage due to false, manipulated information such as fake news is increasing.
Recently, damage due to so-called fake news which is based on unverified information in portal sites, SNS, etc. and disseminated in the form of media reports is occurring, but the current Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., has failed to provide a proper response.
Therefore, there is a need to define fake news resulting in increasing social damage as “falsely manipulated information,” and provide legal and systematic devices to prevent damage from occurring due to dissemination of falsely manipulated information.

Information prepared in the form of a media report to prevent the consumer from realizing that its contents are fictitious, with the aim of deceiving another party commercially or politically using information as a means through the information and communications network, or presenting certain information as verified facts when it does not meet the journalistic criterion of factual verification, shall be defined as falsely manipulated information, and, in the case of falsely manipulated information being displayed on an information and communications network operated or managed by an information and communications service provider according to Article 2 (1) 14 of the Act, the provider shall delete such contents without delay, and a provider who fails to do so shall be subject to administrative fine, in order to prevent damage due to falsely manipulated information (Articles 2 (1) 14, Article 44-2 (7), newly inserted, and Article 76 (1) 6-2).
Note
This proposal is conditional on the passing of the Partial Amendment to the Framework Act on National Informatization (Bill No. 816) and Partial Amendment to the Broadcasting Act (Bill No. 814) chiefly authored by National Assemblyman Pil-mo Jung, and as such, in the event such bills are not passed or are passed with amendments, the contents of this proposal shall require adjustments accordingly.
