Reasons for Proposal

Recently, a car ran up on a sidewalk in a school zone near an elementary school in Haeundae-gu, Busan, killing a child and injuring the child’s parent. It has been pointed out that a banner hung in the school zone interfered with the pedestrian's sight, making the child unable to see the approaching car and leading to death.

Therefore, if an advertisement is displayed or installed near the road in protection areas for children, older persons, and persons with disabilities where these people often walk, there is a risk that it may interfere with the driver’s and pedestrian's field of vision and lead to a serious accident.

In this regard, this Act aims to ban the display and installation of any advertisement in protection areas in principle and sentence any violator to up to 1 year in prison or up to 10 million won in fines (Article 4 (2) newly inserted, Article 18 (1) 3, etc.).

Note

This Act rests on the premise that the “Partial Amendment to the Road Traffic Act” (Bill No. 1056), represented and proposed by National Assembly Member Kim Mi-ae, passes the National Assembly. If the bill is not passed or is passed with modification, this Act must be adjusted accordingly.


Major Provisions

If an advertisement is displayed or installed near the road in protection areas for children, older persons, and persons with disabilities where these people often walk, there is a risk that it may interfere with the driver’s and pedestrian's field of vision and lead to a serious accident.
