Reasons for Proposal
The current Act defines a "No Stopping and Parking" area deemed necessary by the commissioner of a district police agency to prevent any risk on the road and ensure traffic safety and smooth traffic flow, imposes penalties and administrative fines on any violation of a Stopping/Parking ban, states that protection areas for children are not a "No Stopping and Parking" area under law, and allows for banning motor vehicles and horse drawn vehicles from stopping or parking by Ordinance of the Ministry of the Interior and Safety.
However, a car stopping or parking in protection areas for children has been recently suggested as one of the causes for car accidents in such areas as it may interfere with the driver’s field of vision and make them drive forward without noticing a child, which calls for an improvement.
In this regard, this Act aims to specify protection areas for children as one of the "No Stopping and Parking" areas, increase statutory punishment up to 300,000 won in fines or misdemeanor imprisonment for any violation, and raise administrative fines imposed on the employer if the driver cannot be identified to 200,000 won up to 300,000 won, and prepare the basis to root out stopping or parking problems in protection areas for children (Articles 32 (5-2) and 154 (10) newly established, 34-2, 156, 160, 161, and 162).
