Reasons for Proposal

Public unrest over traffic accidents (three persons killed, seven persons injured) involving trucks has been on the rise since the rear-end collision of an aged truck (MY 2001 that occurred in front of the Changwon Tunnel in November 2017. 

Furthermore, as the trucks age, they are increasingly found to be unfit during vehicle inspection, thereby endangering traffic safety. 

In this regard, even if an aged truck is found to be unfit during a periodic inspection under Article 43 of the “Motor Vehicle Management Act,” it remains exposed to the risk of traffic accidents since there are no means to restrict the operation of the vehicle under the “Trucking Transport Business Act.”

Accordingly, the Act aims to enhance the safety management of aged trucks by requiring aged trucks for business that reach a certain age to undergo a periodic inspection pursuant to the “Motor Vehicle Management Act” and to operate in a state that is in compliance with the inspection standards, and limiting their operations if they violate the said requirements (Article 11 (2) newly inserted).
