Reasons for Proposal
This Act aims to improve and supplement some shortcomings found in the operation of the current system by preparing a domestic system to perform health promotion activities for those who are required to receive aviation medical certification such as pilots specified by the International Civil Aviation Organization (ICAO) as international standards (November 2018).
Details
A. Mandate the compliance of aviation medical certification holders with the scope of aviation duties (Article 40)
Prepare a system that mandates the compliance of aviation medical certification holders with the limited scope of aviation duties considering their experience and ability, even if they fall short of aviation medical certification criteria
B. Mandate the establishment and implementation of a health promotion activity plan (Article 41-2 newly inserted)
Put in place a system that mandates air operators to establish a health promotion activity plan for their pilots in accordance with international standards by the International Civil Aviation Organization (ICAO)
C. Prepare a basis for punishing air operators for failing to perform health promotion activities (Articles 86, 87, and 91)
Prepare a system that suspends the aircraft operation of air operators and aircraft use business entities and orders air traffic services to be stopped if they do not implement health promotion activities for pilots or air traffic controllers
