Reasons for Proposal
The current Act prohibits dumping wastes in any area other than designated areas in the provision on the prohibition against dumping wastes under Article 8 (1), but the Act lacks any provision on controlling dumping that violated the designated method.
For example, discharging household waste in standard waste bags in areas other than those designated may be subject to administrative measures such as administrative fines under Article 68 (3) 1 of the same Act, but it is not possible to enforce administrative measures against an act of discharging household waste in nonstandard waste bags in designated discharging areas.
Therefore, in addition to the provisions under Article 8 (1) of the Wastes Control Act on the location or equipment of waste dumping, the Amendment aims to enable the enforcement of measures such as the imposition of administrative fines, etc., when the waste dumping method is violated by means such as the use of nonstandard waste bags, thereby enhancing the effectiveness of waste dumping control (Article 8 (1)).
Major Provisions
In addition to the provisions under Article 8 (1) of the Wastes Control Act on the location or equipment of waste dumping, enable the enforcement of measures such as the imposition of administrative fines, etc., when the waste dumping method is violated by means such as the use of nonstandard waste bags (Article 8 (1)).
